The crucial role of BBBEE consultants when navigating compliance

In today’s dynamic business environment, adhering to broad-based black economic empowerment (BBBEE) standards is essential for companies striving for sustainable growth and inclusivity. Traditionally, the core functions of BBBEE consultants include reviewing current BBBEE scores, recommending strategic changes and indirectly assisting with the BBBEE verification process.

However, the scope of a consultant’s role extends beyond these fundamental tasks. According to the South African National Accreditation System (SANAS) R47-03 document, BBBEE consultants are involved in activities such as coaching, facilitating BBBEE processes and providing specific advice tailored to organisational needs.

Van der Merwe highlights two primary reasons organisations engage BBBEE consultants: a lack of internal BBBEE knowledge, and inadequate resources for implementation. “Many organisations struggle to keep up with the evolving BBBEE landscape due to its complexity. BBBEE consultants bridge this knowledge gap and ensure strategies align with current requirements. Moreover, BBBEE consultants assist in driving internal processes, particularly when internal resources are insufficient – ensuring effective implementation of BBBEE strategies.”

While BBBEE consultants provide invaluable support, organisations must prioritise sustainability and alignment with long-term goals. Van der Merwe advises: “A sustainable BBBEE strategy integrates seamlessly with organisational and country objectives, fostering growth opportunities while fulfilling compliance requirements.”

He also emphasises the importance of BBBEE consultants possessing industry-specific knowledge to tailor strategies effectively. By understanding the operational and legal environment in which organisations operate, BBBEE consultants can devise more relevant and feasible solutions.

However, organisations must exercise caution to maintain impartiality during the BBBEE verification process. Van der Merwe warns against conflicts of interest between BBBEE consultants and BBBEE rating agencies, stressing the importance of adherence to SANAS R47-03 guidelines to avoid potential repercussions.

In some cases, organisations opt to appoint internal transformation managers to oversee BBBEE compliance. While this approach offers integration benefits, Van der Merwe advises organisations to equip transformation managers with up-to-date knowledge and necessary authority to drive change effectively.
